General Terms and Conditions
1. Scope and Acceptance
These General Terms and Conditions govern the use of the website uniquejewelry-us.com and all purchases made through it. By using this website and placing an order, you accept these terms in full. If you do not agree with any part of these terms, you should not use this website or make a purchase. These terms form a legally binding agreement between you and us.
We reserve the right to update or modify these General Terms and Conditions at any time. Any changes will become effective immediately upon being posted on this website. It is your responsibility to review these terms periodically. Your continued use of the website following any changes constitutes your acceptance of those changes.
2. Products and Product Information
Our website offers a curated selection of jewelry distinguished by its artisan craftsmanship and distinctive design. Each piece is the result of a meticulous creative process, from initial inspiration and hand-drawn sketches to the final finishing touches. The materials used are carefully selected, and the designs reflect a commitment to unique expression and individuality.
We strive to ensure all product descriptions, images, and specifications displayed on this website are accurate and presented in good faith. However, please note that slight variations in color, texture, and dimensions may occur. These can be due to the handcrafted nature of the items, the use of natural materials, or the settings of your individual viewing screen. Product offers on the website are valid while stock lasts.
3. Orders and Formation of Contract
Placing an order on our website constitutes an offer to purchase the products in your shopping cart. All orders are subject to our acceptance. We will confirm receipt of your order via an automated email; however, this email does not signify our acceptance of your order.
A legally binding contract between you and us is only formed when we send you an order confirmation email confirming that your order has been accepted and is being processed. We reserve the right, at our sole discretion, to refuse or cancel any order for legitimate reasons, including but not limited to product unavailability, an error in the description or price, or if we suspect fraudulent or unauthorized activity.
4. Availability
While we make every effort to ensure the products displayed on the website are available for purchase, we cannot guarantee the availability of any particular item. If a product you have ordered is unavailable after your order has been placed, we will contact you to inform you of this. In such cases, we may offer you the option to purchase a substitute product of equivalent quality and value, or we will cancel the unavailable item from your order.
5. Right of Withdrawal and Returns
As a customer, you generally have a right to withdraw from a purchase contract and return the goods. You have a period of fourteen (14) days from the day on which you receive physical possession of the goods to exercise this right without giving any reason.
To exercise your right of withdrawal, you must inform us of your decision via a clear statement. You can do so by using a model cancellation form provided by us or by sending us any other unambiguous declaration of your intention to withdraw from the contract.
You must send back the goods without undue delay and, in any event, not later than fourteen (14) days from the day you communicate your withdrawal to us. The deadline is met if you send the goods back before the fourteen-day period has expired.
Upon receiving your withdrawal notice and the returned goods (or proof of return), we will reimburse all payments received from you for the returned products, including standard delivery costs. We will make the reimbursement using the same means of payment you used for the initial transaction. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back.
Please note that the right of withdrawal does not apply to contracts for the supply of goods that are made to your specifications or are clearly personalized, such as bespoke or custom-made jewelry. You are responsible for the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
6. Product Care and Accuracy
Our jewelry is crafted with care. To ensure its longevity, we recommend protecting your pieces from contact with harsh chemicals, water, and abrasive surfaces. Please refer to individual product descriptions or any care instructions provided with your order for specific information.
While we endeavor to provide accurate product descriptions and images, these are intended for illustrative purposes. Due to the artisan techniques employed in creating these pieces, each item is unique and may differ slightly from the image shown. All information about the products, including their essential characteristics, is provided on the product detail page.
7. Limitation of Liability
To the fullest extent permitted by applicable law, our liability for any claim arising out of or in connection with your use of the website or the purchase of our products shall be limited to the total price you paid for the specific product that gave rise to the claim. We shall not be liable for any indirect, incidental, special, or consequential damages.
Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
8. Governing Law
These General Terms and Conditions and any disputes arising from or in connection with them shall be governed by and construed in accordance with the laws applicable to our jurisdiction.
